Beta terms

Tainure is run by its operator, Mathias Wendlinger, in his own name, in the European Union. In these terms, “Tainure” means him.

The product is unfinished. Things will change, some will break, and a change may lose data despite the backups. Tainure is provided as it is, without a warranty of any kind, and free of charge during the beta.

Tainure is a tool for your work, and you use it as a professional.

• Your organisation's rules come first. Use Tainure for your work only if your organisation's policies allow it; by using it for your work, you confirm that they do. This covers what you write about yourself too, since a note about your own work usually names colleagues.
• You write about the people you work with as part of your job, the way you would in any notebook. By writing in Tainure you confirm that you have the right to write what you write.
• Keep your notes neutral, factual and about the work. Write what happened, what was said and what was agreed. Never write about someone else's health, beliefs, union membership or private life. Write as if the person could read it, since they may have the right to.
• Where the law requires the people you write about to be told that you keep notes on your work with them, telling them is yours to do.

You decide what goes into your workspace and why. Under data protection law you are the controller of your notes (or your employer is, if you use Tainure on its behalf), and Tainure is your processor. Tainure handles them only to run the service for you, under the annex at the end of these terms. For your account, your invite request and the usage counts, Tainure is the controller, as the privacy page describes.

• To handle your notes as described on the privacy page and in the annex below, and to tell you before that changes.
• To keep your data one click away (“Download my data”, in the account menu), and to delete your workspace when you ask.
• To tell you when the beta ends or turns into something paid, with time to leave before it does.

• Your feedback. A beta only works if you tell us what helped and what got in the way; expect a short conversation after a few weeks.
• One workspace, one person. Your address and password are yours; do not share them.
• Ordinary use. No attempt to reach another workspace, to overload the service, or to use the AI for anything other than your own work with your team.

Tainure is a notebook and a coach for your own conversations. It is not a tool for deciding about people. Nothing it writes, extracts or suggests is a performance rating, and it must never be the sole basis of a disciplinary, pay or promotion decision about anyone. Its notes about a person are what you wrote and confirmed.

Tainure removes medical details before saving, and keeps only what the work needs, such as an absence.

You can leave at any time. Write to beta@tainure.com and your workspace is deleted. Tainure can end the beta itself, for everyone, with a week's notice. It suspends or ends your own access only on a court order, on a demand from an authority, or once it has established that these terms were broken, and it tells you unless the law forbids it. During a suspension your data is left untouched, and Tainure sends you your export when you ask. Either way, the privacy page's rules on deletion apply.

You use Tainure for your work, and these limits are written for that. To the extent the law allows, Tainure is not liable for indirect losses, such as lost business or harm to your reputation, and its total liability to you is limited to what you paid for Tainure in the twelve months before the claim. These limits do not apply to wilful misconduct or gross negligence, or where the law does not allow them.

If what you write in Tainure breaks these terms or the law, for example because you had no right to write it, you answer for it, and if someone brings a claim against Tainure because of it, you cover what that costs Tainure.

These terms are governed by the law of the operator's country in the European Union.

This annex is the agreement data protection law asks for between you, as controller of your notes, and Tainure, as your processor (Article 28 of the GDPR).

• What, whose and for how long. The names and notes you write about the people you work with and about yourself, the text you paste, your agenda items and checklists, and your conversations with the assistant, for as long as you use Tainure.
• Your instructions. Tainure stores them, shows them to you, and sends the relevant part to its AI provider when you paste notes, open a briefing, chat or save, to give you the result. It uses them for nothing else. Your instructions are these terms and what you do in the product. If one seems to break data protection law, Tainure tells you.
• Confidentiality. At Tainure, only the operator can reach your workspace's database. He keeps what he sees confidential, and reads a workspace only to fix a problem you asked about, telling you when that happens.
• Security. Each workspace is its own database, your password is stored only as a hash, and the site is served only over HTTPS.
• Other companies. Your notes go only to the companies the privacy page names for them, which handle them on Tainure's instructions. Before another company receives your notes, that list changes and you are asked to accept it the next time you open your workspace; if you object, you can take your data and leave.
• Requests and breaches. Tainure forwards to you any request about your notes from a person you wrote about, and helps you answer it. If a breach reaches your workspace, Tainure tells you without undue delay, with what it knows, and helps you with any notice the law asks of you.
• At the end. When you leave, Tainure destroys your workspace's database and keeps no copy of your notes; take what you want first with “Download my data”. The host's backups expire as the privacy page says.
• Proof. Tainure answers in writing any question you have about how it handles your notes, with the information you need to check that it keeps to this annex.
